Stepmother of 38-year-old man accused of shooting teen girl in murder-suicide says he snapped, 'was just a lost soul looking for someone to love him'

MONROE -- Family of 38-year-old Raymond Bush, who police say abducted and fatally shot a 15-year-old Evart girl before taking his own life, defended him today as a good person who simply snapped.

Bush and the girl, Taylor Manley, had been in a relationship for about a year, said Bush's stepmother, Maryann Bush.

"I think he was just a lost soul looking for someone to love him," she said.

Bush was the father of a 17-year-old daughter and 11-year-old son from previous relationships. He bought and fixed-up a van for his daughter, who recently gave birth.

Maryann Bush said her stepson was afraid of going to jail after he was charged with sexually assaulting Taylor.

She is upset that others are portraying Bush as a pedophile.

"We all know that two families are suffering, but people are portraying him like he's a real bad person. But that's not like it was," Maryann Bush said.

She claimed Bush, who was not working, did not have a criminal record.
Oseceola County prosecutors say Taylor planned to testify against Bush at a probable cause hearing Wednesday, but Bush believed she would not.

Bush and Taylor got to know each other because she once lived next door to the grandparents of his son, in the Monroe area.

On Wednesday, Bush talked to his ex-girlfriend on the phone and later stopped at her home. Bush allegedly told the ex-girlfriend he killed Taylor and planned to kill himself because "that was the only way they could be together."

CA- Boy was killed to hide sex crime, affidavit says

11-5-2009 California:

FRESNO, Calif. (AP) — A 14-year-old with a baby face told investigators he drowned his 4-year-old neighbor in a bathtub, then hid the body in a dryer, because the child was going to reveal the teen molested him, according to an affidavit released when he appeared in court Wednesday.

Raul Renato Castro, dressed in a purple T-shirt issued at the juvenile jail, appeared emotionless while staring at his hands in Fresno County Superior Court.

He was guarded by five bailiffs and two officers outfitted in paramilitary gear.

“He won’t cry, he won’t cry, he won’t,” said a woman who identified herself as his aunt but refused to give her name because she said the family had received death threats. Police could not confirm there had been threats.

Police said searchers found Alex Mercado on Saturday stuffed in the clothes dryer in the small farm town of Mendota.

The affidavit said Castro, a student at Mendota Junior High School, initially told police he knew nothing of the boy’s disappearance. When investigators said the boy had been found in the dryer, the teen suggested someone had broken into the house and put him there.

Castro eventually told police he had enticed the dimpled, brown-eyed boy into his house across the street and sodomized him, the affidavit states. He said he killed Mercado after the child fell and hit his head, started crying, then threatened to tell his mother, the document states.

“Castro said he panicked and decided to kill the victim by drowning him in the bathtub,” the affidavit says.

The teen, who is 5-feet tall and weighs 170 pounds, put Mercado’s body over his shoulder and carried him to the dryer, hoping everything “would go away,” the affidavit states.

Castro had been scheduled for arraignment as an adult on charges of first-degree murder, sodomy, child molestation, kidnapping and murder to silence a witness.

The arraignment was rescheduled for Tuesday after his acting public defender, Kathy Marousek, said she had not seen the paperwork.

“He told me he was scared,” said Marousek, who spoke with the teen as he sat in the jury box. “He could be in shock.”

Marousek said after the hearing that she doubted the teenager understood the Miranda Rights read to him by investigators, which could put his confession in doubt.

Earlier the teen had nodded without expression when Judge Jon Kapetan asked him if he understood the proceedings. Bail was set at $2.1 million.

California law says suspects 14 and older can be charged and tried as adults. About 20 percent of murders in the state are committed by people between the ages of 11 and 17.

Castro, who turned 14 on July 29, cannot face the death penalty but could be sentenced to as long as 47 years-to-life if convicted. ..Source.. by New Haven Register

NC- Pregnant teen shot to death at bus stop

9-15-2009 North Carolina:

CHARLOTTE -- A Charlotte man wanted for raping his adopted teenage sister turned himself in Monday and was being questioned in connection with her shooting death at a Charlotte school bus stop, police said.

Royce Anthony Mitchell, 36, is a "person of interest" in the slaying of Tiffany Wright, 15, in north Charlotte, according to a Charlotte-Mecklenburg police spokesman.

Tiffany, who was eight months pregnant and living in a foster home, was shot about 6 a.m. Monday while waiting to catch the bus to her high school.

Medics rushed her to Carolinas Medical Center, where doctors were able to deliver her baby girl. Wright died at the hospital, and the baby was listed in critical condition Monday.

Police issued warrants against Mitchell for statutory rape and indecent liberties with a minor Monday, based on their investigation into Tiffany's death. A police spokesman said Tiffany was the victim of the alleged sex crimes, and that she had been adopted into the Mitchell family.

Police were at Royce Mitchell's home late Monday, as homicide detectives questioned him at police headquarters. Police also said they're looking into whether Mitchell is the father of Tiffany's baby.

Records show Mitchell has no criminal record in North Carolina. In 2008, his wife took out a restraining order against Mitchell, alleging domestic violence, but the case was dismissed.

Federal prison records show a Royce Mitchell, age 36, had been sentenced in 2002 to six years in prison for conspiring to sell drugs in Buffalo, N.Y. Charlotte police couldn't confirm whether that was the same man charged in Monday's case, but records show Mitchell previously lived in Buffalo.

Accounts in the Buffalo News said Royce Mitchell was a quarterback for the semi-professional Buffalo Lancers football team, before being busted on federal drug charges.

The shooting occurred less than a block from her apartment.

Late Monday, five of Tiffany's friends visited the bus stop where she was shot. They wept and hugged one another near the stop, marked by a single bouquet of flowers.

They described Tiffany as goofy and fun, and a good student. She ran track at Bessemer City High, where she previously attended school, and she liked to dance.

"She couldn't dance, but she loved to try," said DeNeika Parker, 17.

Tiffany planned to name her baby Aaliyah and was excited about becoming a mother, said Tyanna Barnette, 16, who said she had known Tiffany since the two were in middle school.

Tiffany was a junior at Hawthorne. Principal Tracey Pickard said Tiffany came to the school in August as a student in the TAPS program for pregnant students. She said the girl had impressed teachers.

"It was clear that Tiffany was academically strong and off to a good start," Pickard said. She said the girl's teachers told her that Tiffany "was extremely focused."

Students at Hawthorne remembered Wright as a smart, friendly girl who did well in school and was always sweet.

"She always had a smile on her face," said Cameron Blakeney, a sophomore who met her at the movies last summer. "She loved to joke. I'm like, devastated, like a lot of people," Blakeney said. "We're all pretty torn up on the inside."

Charlotte-Mecklenburg school officials dispatched crisis teams Monday to counsel students who knew Wright. They also said they will work with CMPD to increase police visibility at the bus stop and Hawthorne for the next few days.

Tiffany's grandmother Shirley Boston in Buffalo was shocked and tearful when she learned of her granddaughter's death late Monday.

She spoke with her two weeks ago and was looking forward to helping care for her great-granddaughter. "I had my other granddaughter text her today (Monday) to say she didn't need to buy anything for the baby" because the family would take care of it, Boston said.

Boston said Tiffany spent several childhood years in Buffalo, where her father also lives.

She moved to the Charlotte area and was sent into foster care after her mother lost custody, Boston said. Mecklenburg County DSS officials would not confirm that Monday. The Charlotte Observer was unable to reach Tiffany's foster mother.

Tiffany had managed to keep a positive outlook, despite the challenges in her life, said Ashelee Barber, who said she was the niece of Tiffany's foster mother.

CA- Prosecutor: Man Killed Son, Baby's Mom Over Paternity Case

SAN DIEGO -- Jury deliberations began today in the double-murder trial of a Bonita man accused of strangling the mother of his child and killing his 10-month-old son after she threatened to bring a paternity case.

Dennis Potts, 25, faces life in prison without the possibility of parole if convicted of murdering 22-year-old Tori Vienneau and their child, Dean Springstube.

Deputy District Attorney Per Hellstrom told jurors in his closing argument that Vienneau was killed on July 26, 2006, on a night she and Potts had dinner plans.

Potts lied to police when he told them he called off dinner with Vienneau, Hellstrom said, because it was the victim who canceled the meeting.

That was the night that the 22-year-old victim planned to tell Potts she was taking him to court over the paternity of their baby, according to Hellstrom.

"This was clearly the catalyst that caused Mr. Potts to kill her," the prosecutor said, telling the jury a notion that a stranger broke into Vienneau's apartment and killed her and her baby was an "absurd conclusion."

A "ping" from a cell phone tower at 6:44 p.m. put the defendant near the victim's apartment in south San Diego around the time she was killed, the prosecutor said.

"(He) simply doesn't have the courage to admit what he did that night," Hellstrom told the jury.

The man who the defense claimed is the real killer, Daniel Moen, couldn't have committed the crimes because he was at work, the prosecutor said.

Besides, Moen cared for Vienneau and loved her baby, Hellstrom said.

"He (Moen) cannot have committed this crime," the prosecutor said. "He must be innocent."

By contrast, Potts had no relationship with his son and lied "up and down" about his role in the murders, Hellstrom said.

The defendant's lifestyle was at risk if he was proven to be the baby's father, the prosecutor said.

Potts erased all of his text messages from that night, then ordered his cell phone records and altered them, the prosecutor said.

The defendant said he was at friend Max Corn's home working on a project when Vienneau was killed.

Hellstrom labeled as "chilling" the Internet searches done by Potts a month before the murders, in which he researched such topics as "how to cheat a swab paternity test," "the best way to kill someone," "getting away with murder" and "getting out of child support."

Defense attorney Kerry Armstrong told the jury that Potts did the searches in connection with a school paper on euthanasia
. He also had some fascination with death, was interested in mixed martial arts and was worried about his father's failing health, his lawyer said.

Potts' palm print on the door jam of the room where the baby was hung in his crib could have been put there weeks before, because the defendant had been to Vienneau's apartment three or four times, Armstrong argued.

Potts made changes to his cell phone records because he was "scared," but never showed the altered records to anyone, his attorney said.

Just because Potts lied to police doesn't mean he's guilty of murder, Armstrong said.

According to a defense expert, it is possible that Potts was at Corn's house when he took a call from his mother and the call "pinged" off the cell tower near the victim's apartment, Armstrong said.

There is no direct evidence linking Potts to the murders, the defense attorney said.

"This is a 100 percent circumstantial case," Armstrong told the jury.

Hellstrom told the jury that Potts surprised Vienneau in her apartment, knocking her unconscious and then strangling her with the cord from a hair-straightening iron. Potts ripped the victim's blouse to try to make it look like she was sexually assaulted, the prosecutor said.

The defendant then proceeded to the baby's room and hung the child in his crib with a cord from a cell phone charger, Hellstrom said.

"He (the baby) died alone with his mom in the room next door," the prosecutor told the jury.

Hellstrom said Potts lied to police when he said a paternity test he took was legitimate, when in fact he had used his friend Corn's DNA to submit for the test.

Potts is charged with two counts of murder and a special circumstance allegation of multiple murders, along with a charge of conspiracy to obstruct justice.

Corn, who faces a conspiracy charge, will be tried following Potts' trial. ..Source.. by 10News.com


CA- Bonita man who killed his son and baby’s mother gets life terms

A Bonita man who strangled his 10-month-old son and the baby’s mother because she was pressuring him to admit parentage was sentenced Friday to consecutive life prison terms with no possibility of parole.

Dennis Potts, 25, was convicted Sept. 10 of two counts of first-degree murder in the July 26, 2006, deaths of 22-year-old Tori Vienneau and their child, Dean Springstube.

Judge Bernard Revak, who has worked in the criminal justice system for nearly 45 years, said the case “cried out” for consecutive sentences.

“This case stands at the top of the list of cruel, uncaring, brutal (crimes) … with the gravest amount of malice that I have ever seen,” the judge said.

Revak said he hoped Potts would never be released from prison.

Deputy District Attorney Per Hellstrom called Potts “amoral, selfish and vindictive.”

“This man executed his own son,” the prosecutor said, calling the murders of Vienneau and her child “one of the most evil acts this community has ever seen.”

The prosecutor said Potts caught Vienneau off guard by telling her they were going out to dinner in La Jolla. Once in her apartment, Potts strangled her and then strangled the child in his crib, the prosecutor said.

“This is not a crime that this man should ever be released from prison,” Hellstrom told the judge. “He should spend the rest of his life in a cage.”

A “ping” from a cell phone tower at 6:44 p.m. put the defendant near the victim’s apartment in south San Diego around the time she was killed, the prosecutor said. The man who the defense claimed was the real killer, Daniel Moen, couldn’t have committed the crimes because he was at work, the prosecutor said. Besides, Moen cared for Vienneau and loved her baby, Hellstrom said.

Moen’s sister, Breanne, told that judge that her brother was “hit hard” by the murders of his best friend and her son.

“Daniel took it to heart to help his friend out,” his sister said. “Dean was Daniel’s buddy.”

Vienneau’s father, Roy Herroz, said Potts’ goal was murdering his daughter and her baby and getting away with it.

“What kind of animal murders his own son?” he asked. “What kind of parents stand beside such an animal?”

Herroz said he lost not only his daughter and grandson, but his job and his wife as he knew her before the murders.

“She is heavily medicated just to get by,” he said. “We’re still together, but we’re broken. Let Dennis Potts rot in his cell,” he said.

“That’s where he deserves to be.” Hs wife, Dayna, said Potts’ choice to kill her daughter and grandson “went beyond evil.”

She said it had been hard for her daughter to ask Potts to take a court- ordered paternity test, but she needed child support.

“She was a single mother doing the best she could,” Dayna Herroz said of her daughter. She said she hoped a photo of her daughter and grandson in the casket together would hang in Potts’ cell. “My only other wish is that when Dennis does die, that he rots in hell for all eternity,” she said.

Revak said Potts never thought investigators would recover the hard drive from his computer and discover that in the weeks before the murders, the defendant did Internet searches for “committing murder,” “how to cheat a swab paternity test,” “the best way to kill someone,” “getting away with murder” and “getting out of child support.”

Potts kept the fact that he was the baby’s father from his parents and fiancee.

“This case is really about choices, and the responsibility we bear for our choices,” the judge said.

OH- Mom Accused in Baby's Death Facing Sex Charge

The prosecutor alleges she was trying to hide the fact that the father was a minor, and if true there is something else we need to find out. We need to follow case to learn if, her underlying reason was A) she didn't want family or friends to know; -OR- B) whther she was afraid of the ramifications of the laws involving sex with minors, as alleged by the prosecutor.

8-31-2009 Ohio:

A Hamilton woman held in the murder of her five week old child now faces charges of sexual conduct with a minor and allegedly killed her child to hide the age of the father.

25 year old Asuncion Villa was indicted today by a Butler County grand jury on charges of aggravated murder, tampering with evidence, and abuse of a corpse. But there was also a fourth count in the indictment, alleging that Villa had sex with a minor between the ages of 13 and 16. The alleged sex happened between September and November of 2008.

Villa called police a week ago Monday to say a family member had taken her five week old son Israel Santos from her home on Sunday and had not returned the child.

Detectives began interviewing witnesses and say they found the body of the baby early yesterday wrapped in a plastic bag in a trash can behind the family home. They filed charges against Villa, including Murder, Endangering Children, Tampering with Evidence and Abuse of a Corpse. The coroner says the child had a crushed skull and a fractured right forearm.

Today's indictment allegeds Villa killed the baby to hide the fact that she'd fathered the child with a minor.

Villa is held on a million dollars bond on the charges stemming from her baby's death and could face the death penalty if she's convicted. ..Source.. by Local12.com

Baby's death brings death-penalty charge

A Hamilton woman killed her infant son and put him in the trash, authorities allege, because she wanted to conceal the fact that she had unlawful sex with a teen who fathered the baby.

That scenario added up to charges that could bring the death penalty for Asuncion Avila-Villa, 26, of Hamilton, if she is convicted.

Authorities believe she is the first woman facing possible capital punishment in Butler County in about a decade.

“The facts of this case are so horrific, it justifies it,” said Prosecutor Robin Piper.

Avila-Villa, who is being held in the county jail on a $1 million bond, is set to appear in court today1 on upgraded charges that were released Monday.

An indictment accuses Avila-Villa of aggravated murder in the death of her 35-day-old son, Israel Santos. He died of a crushed skull.

Police found the child’s body Aug. 25 amid trash they had taken to police headquarters from behind Avila-Villa’s Shuler Avenue apartment.

The indictment lists two reasons the death penalty could be imposed, if a jury agrees either or both conditions apply: The victim of the slaying was a child under age 13, and the killing was committed “for the purpose of escaping detection, apprehension, trial or punishment for another offense” – unlawful sexual conduct with a minor.

The latter specification refers to Avila-Villa’s conduct with the teen who is believed to have fathered the baby, Piper said.

Authorities are not disclosing the teen’s whereabouts but say they have talked to him.

Besides aggravated murder and unlawful sexual conduct with a minor, Avila-Villa also is accused of gross abuse of a corpse and evidence tampering.

A paternity test for the child was imminent when he died on or before Aug. 24, Piper said.

The test was about to be done because Avila-Villa was receiving public assistance.

In such a situation, government officials attempt to determine the child’s parentage and collect child-support payments from the parent who doesn’t have custody.

Avila-Villa killed the child and put him in the trash because she didn’t want authorities to discover her sex crime with the teen boy who fathered Israel, Piper said.

In a call to 911, Avila-Villa reported Israel missing and blamed the baby’s father, who she said was 21, for taking him.

Authorities say that report was false. They say the likely father is a boy whose age is between 13 and 16. DNA testing has not yet been completed to verify whether the teen did indeed father the child. ..Source.. by Janice Morse

Mom denies guilt in baby's death

9-1-2009 Ohio:

A Hamilton woman pleaded not guilty Tuesday to charges that she killed her infant son -- accusations that carry a possible death sentence if she is convicted.

Asuncion Avila-Villa, 26, said little except to answer questions and was expressionless in Butler County Common Pleas Court as one of her lawyers, Chris Pagan, spoke on her behalf.

She is denying charges of aggravated murder, gross abuse of a corpse, tampering with evidence and unlawful sexual conduct with a minor, the purported teen father of Israel Santos, the 35-day-old baby who was found dead last week in the trash. The indictment filed Monday alleges she had sex with a boy between the ages of 13 and 16 from September through November last year.

Israel Santos died of a crushed skull, Butler County Coroner Richard Burkhardt has ruled. Police found his body a week ago amid trash they had taken to the police station from outside Avila-Villa's apartment.

She had reported her son missing but police say that story was fabricated.

Authorities allege Avila-Villa killed the child because she wanted to conceal her sexual relationship with the teen. That relationship was in danger of being discovered because government officials were ordering a paternity test on Israel as part of the normal routine for public-assistance applicants.

Police records say Avila-Villa was born in Mexico. "She's legally here but not a citizen," Pagan said. He said she speaks English well enough that no interpreter would be needed for court proceedings.

She has four other children. Two live with relatives in Texas. Two others living with her in Hamilton have been placed with relatives nearby.

Judge Andrew Nastoff kept Avila-Villa's bond unchanged at $1 million. He set her next court date for Sept. 30.

A separate case is pending over custody of two of her children, and a hearing will be held in that case on Oct.15 in juvenile court. ..Source.. by Janice Morse
